Yes, CBD is legal on a federal level in the United States. This is thanks to a recent piece of legislation known as the Hemp Farming Act of 2018. This law made it legal to sell any hemp-derived product in the United States. The caveat? 

The product must contain less than .03% THC. Sadly, just because a substance is legal federally doesn’t mean it’s legal in all states. States have the power to pass local laws that outlaw the sale and use of CBD, and a handful has done just that. 

What’s more, despite CBD is legal in a state, some local municipalities have made it illegal within the states. As such, you should always do some research in the state where you live. That way, you know for sure what the laws are.

How Old Do You Have to Be to Buy CBD?

For most states in the U.S., you must be eighteen years or older to purchase CBD. However, there are some states that have different laws. For example, you must be twenty-one or older to purchase in Alaska, Illinois, Indiana, Maine, Rhode Island, Tennessee, and Utah. 

On the other hand, states like Alabama, Arizona, Arkansas, Iowa, Maryland, Missouri, Nebraska, Texas, Virginia, and West Virginia have no laws about how old you need to be to purchase CBD.

Why Is There An Age Limit?

Yes, CBD is generally safe, but there are some excellent reasons there are age limits. First, there aren’t many clinical tests on the safety of long-term CBD use for children. 

What’s more, there are a lot of poor-quality CBD products out there that contain heavy metals, molds, and even pesticides which would be awful for kids. Lastly, if CBD is in the gummy form, it’s easy for a child to eat too much. This can lead to a negative experience if they go overboard.

One solution to this is regulation for children. So far, the FDA has only approved one medication that uses CBD to treat epilepsy.

The Importance of Being Old Enough For CBD

It’s true that there are no age restrictions in some states when it comes to CBD. However, just because there are no age restrictions doesn’t necessarily mean that your child should be taking it. Most of the time, it’s best to wait until your child’s eighteen before allowing them to use it. 

That being said, there are scenarios where it might be appropriate to let your child use CBD at a younger age. 

For example, if they want to try using CBD to attempt to treat the symptoms of a condition like epilepsy, it could be worth a shot. However, otherwise, it’s best to let them wait until the legal age.
